By accessing or using the WayJet platform (the "Service") at assistant.wayjet.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and WayJet LLC ("WayJet," "we," "us," or "our"), a company organized under the laws of the State of Delaware, United States.
You must be at least 16 years of age to use the Service. Users between the ages of 13 and 16 may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
WayJet provides AI-powered analysis tools including, but not limited to: medical report analysis, drug interaction checking, prescription decoding, health trend tracking, calorie estimation, food package analysis, menu scanning, contract review, and AI health chat. The Service is available through web browsers and may be expanded to additional platforms. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
To access certain features of the Service, you must create an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your account information; (c) maintain the security and confidentiality of your login credentials; (d) accept responsibility for all activities that occur under your account; and (e) notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
WayJet offers Free, Pro ($9.99/month), and Max ($19.99/month) subscription plans. By subscribing to a paid plan, you agree to the following: • Recurring Billing: Paid plans are billed on a monthly recurring basis. Your payment method will be automatically charged at the beginning of each billing cycle. • Free Trial: If offered, free trial periods will convert to paid subscriptions at the end of the trial unless cancelled. • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial billing periods. • Price Changes: We may change subscription prices with 30 days' advance notice. Continued use after a price change constitutes acceptance of the new price. • Taxes: Prices are exclusive of applicable taxes. You are responsible for any taxes imposed on your subscription.
IMPORTANT — PLEASE READ CAREFULLY: The Service provides AI-generated health information for educational and informational purposes only. The Service does NOT constitute medical advice, diagnosis, or treatment. WayJet is NOT a healthcare provider, medical device, or clinical laboratory. • Do not rely on the Service for medical decisions. Always consult a qualified healthcare professional for medical advice. • AI-generated analysis may contain errors, omissions, or inaccuracies. The Service should be used as a supplementary educational tool only. • In case of a medical emergency, call 911 (in the United States) or your local emergency number immediately. • The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. • Drug interaction results are not exhaustive and may not reflect all possible interactions. Always consult your pharmacist or physician.
Our AI analysis tools generate content based on machine learning models and medical reference databases. You acknowledge and agree that: • AI-generated content may not always be accurate, complete, or up-to-date. • AI outputs reflect patterns in training data and may not account for your specific medical context. • We make no warranties regarding the accuracy, reliability, or completeness of AI-generated content. • You are solely responsible for how you use or act upon AI-generated information. • AI analysis results should be verified with qualified professionals before making health-related decisions.
You retain full ownership of all content you upload to the Service, including medical reports, prescriptions, food labels, and other documents ("User Content"). By uploading User Content, you grant WayJet a limited, non-exclusive, non-transferable license to process, analyze, and store your User Content solely for the purpose of providing the Service to you. We will not: (a) share your User Content with other users; (b) use your User Content for training AI models without your explicit consent; (c) access your User Content except as necessary to provide the Service or as required by law.
The Service, including its design, logos, trademarks, source code, AI models, user interface, and documentation, is owned by WayJet LLC and is protected by United States and international intellectual property laws, including copyright, trademark, and trade secret laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. All rights not expressly granted in these Terms are reserved by WayJet.
You agree not to: • Use the Service for any unlawful purpose or in violation of any applicable law or regulation • Upload content that is malicious, harmful, threatening, abusive, defamatory, or otherwise objectionable • Attempt to gain unauthorized access to the Service, other user accounts, or our systems • Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our written permission • Interfere with or disrupt the Service or servers or networks connected to the Service • Impersonate any person or entity, or falsely claim an affiliation with any person or entity • Reverse engineer, decompile, or disassemble any part of the Service • Use AI-generated outputs to create competing products or services • Upload content that infringes on the intellectual property rights of others • Circumvent any usage limits, rate limits, or security measures • Share your account credentials with others or allow others to access your account
The Service may integrate with or contain links to third-party services (e.g., Google OAuth, payment processors). These third-party services are governed by their own terms and privacy policies. WayJet is not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is at your own risk.
You agree to indemnify, defend, and hold harmless WayJet LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any User Content you upload; or (e) any health-related decisions you make based on information obtained through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) IN NO EVENT SHALL WAYJET, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. (b) WAYJET'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO WAYJET IN THE 12 MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100). (c) WAYJET IS NOT LIABLE FOR ANY HEALTH OUTCOMES, MEDICAL DECISIONS, OR ADVERSE EFFECTS RESULTING FROM YOUR USE OF OR RELIANCE ON THE SERVICE. (d) THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WAYJET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WAYJET DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; (C) THE QUALITY OF ANY AI ANALYSIS WILL MEET YOUR EXPECTATIONS; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM WAYJET SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. You and WayJet agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Delaware, or at a location mutually agreed upon. Exceptions: Either party may bring claims in small claims court if they qualify. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement or unauthorized use of the Service. Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@wayjet.io within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement.
YOU AND WAYJET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and WayJet agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class, consolidated, or representative proceeding.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
You may terminate your account at any time through your account settings. WayJet may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or extended periods of inactivity. Upon termination: (a) your right to access the Service immediately ceases; (b) we will delete your personal data in accordance with our Privacy Policy; (c) provisions that by their nature should survive termination shall survive, including Sections 9, 12, 13, 14, 15, 16, and 17.
By creating an account, you consent to receive electronic communications from WayJet, including service announcements, administrative messages, and, where you have opted in, promotional communications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You may opt out of promotional communications at any time via your account settings or by using the unsubscribe link in our emails.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service, updating the "Last updated" date, and sending an email notification. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and WayJet regarding the Service and supersede all prior agreements. Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. WayJet may assign these Terms without restriction. Waiver: The failure of WayJet to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Force Majeure: WayJet shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, pandemics, war, terrorism, government actions, or infrastructure failures. Export Controls: You agree to comply with all applicable export control laws and regulations of the United States.
